AND CONDITIONS AND PRIVACY POLICY

These Terms and Conditions and Privacy Policy (“Policy”) are meant to help you understand what information collected by Middleview Publications referred to herein as (“Middleview,” “we” or “us”), why we collect it, and how you can update, manage, export, and delete your information, as well as your rights and obligations with regard to use of the website David-Richman.com (“Website”). This policy is based on our goal to provide our visitors with quality information and resources while maintaining personal privacy.

By visiting the Website, registering with us or contacting us, you signify that you understand and agree to the collection, use and transfer of your information under the terms of this Policy. If you do not accept, or do not wish to be bound by this policy, please do not use the website.

You must be at least 16 years old to use the Website. If we become aware that a user is under the age of 16 and has provided personal information to us without prior parental consent, we will remove all information provided by such underage user from our database, if any.

What We Do and Don’t Collect and Why

We do not ask for any personal information, unless you wish to request a free copy of “A Guidebook to Your First 5k, 10k, or Sprint Triathlon,” or if you wish to contact author, David Richman.  In those two cases, the only information that must be collected is your email address.  You can choose to provide your first and/or last name (collectively, name and emails address are referred to herein as “Personal Information.”). This information is collected to respond to your requests and/or inquiries, and may be used to contact you in the future re relevant information. 

We never sell or trade your Personal Information is never sold or used for advertising purposes.  We do use third parties to help in contacting you in the future re relevant information.  Currently, the only third party we use is Mailchimp®, whose privacy policy can be accessed here https://mailchimp.com/legal/privacy/.  We may also disclose Personal Information where required to do so by law.

We may offer email updates about new information or products and/or newsletters. If you no longer wish to receive emails, follow the “unsubscribe” instructions located near the bottom of each email.

The Website uses cookies in order to provide you with an improved browsing experience; and to allow us to improve our Website and to serve targeted advertising. We may collect advertising information, including but not limited to, type of ads seen, number of times ads were served, pages where the ads were served, etc.

Our Website, like most other websites, utilizes dynamic IP address information.  We do not store, collect or use IP addresses, unless that information is utilized for analytic services as described below or with cookies as described above.

We may use analytics services, such as Google Analytics, to help us understand how users access and use the Website. In addition, we may work with agencies, advertisers, ad networks, and other technology services to place ads about our products and services on other websites and services. For example, we place ads through Google that you may view on their platforms as well as on other websites and services. As part of this process, we may incorporate tracking technologies into our own Website (including our website and emails) as well as into our ads displayed on other websites and services. Some of these tracking technologies may track your activities across time and services for purposes of associating the different devices you use, and delivering relevant ads and/or other content to you (“Interest-based Advertising”). Google provides tools to allow you to opt out of the use of certain information collected by Google Analytics at https://tools.google.com/dlpage/gaoptout and by Google Analytics for Display Advertising or the Google Display Network at  https://www.google.com/settings/ads/onweb/. Please note that if you opt out using any of these methods, the opt out will only apply to the specific browser or device from which you opt out. We are not responsible for the effectiveness of, or compliance with, any opt out options or programs, or the accuracy of any other entities’ statements regarding their opt out options or programs.

Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Note, however, there is no industry consensus as to what site and app operators should do with regard to these signals. Accordingly, unless and until the law is interpreted to require us to do so, we do not monitor or take action with respect to “Do Not Track” signals.

Prohibited Uses

You are prohibited from using the Website in any way that:

  • Violates or infringes on the rights of anyone else, including, for example, another person’s right to privacy;
  • Impersonates any person, business, entity, or IP Address (e.g. IP Spoofing);
  • Gains or tries to gain unauthorized access to computers and networks, or data, or that otherwise modifies or interferes with the use or operation of the Website;
  • Imposes an unreasonable or disproportionately large load on the Website, including but not limited transmitting spam or using other unsolicited mass emailing techniques;
  • Alters, damages, or deletes any content provided by the Website;
  • Contains computer viruses or other disruptive, damaging or harmful files or programs; or
  • Otherwise violates this Policy.

General Limitations

You agree that the Website is subject to limitations and restrictions outside of our control, which include such things as Internet availability, environmental conditions (such as buildings, weather, geography, and topography), atmospheric conditions, and other factors associated with the use of the Internet or with satellites and satellite data.  We store only Personal Information for the purposes discussed above. Such data may be deleted, modified, or damaged, and we are not responsible for any such deletions, modifications, or damage.

We are committed to maintaining the security of the data you provide us and will take reasonable precautions to protect your personal information. However, there is always some risk in transmitting information over the Internet. Because the Website is provided through mobile networks and the Internet, you understand that when you use the Website, your communications may be intercepted by others and that we cannot guarantee the security and privacy of mobile transmissions or transmissions via the Internet. You agree that we will not be liable for any lack of security relating to the use of the Website by you and that you will not hold us liable for any damages resulting from any loss of privacy or security occurring in connections with any communications over such networks, except where expressly prohibited by law.

The Website is provided on an “as is, as available” basis. Neither Middleview, nor any of its agents, employees or contractors, nor any other party involved in creating, producing, or delivering the Website shall be held liable for any improper or incorrect use of the Website.

Changes to This Policy

We reserve the right to edit and reissue this Policy at any time. Any changes will be effective immediately upon posting of the revised policy. Your continued use of the Website indicates your consent to the Policy then posted. Please check this Policy regularly for any changes. If the changes are material, we may provide you additional notice to your email address, and you expressly consent to receive such notice by using the Website and voluntarily providing us with your email address.
